ABOUT THE WEBSITE AND APPLICABLE TERMS
On the project-o2.org website, we offer the possibility to purchase items that are marked as 'Available' or 'In Stock' on the individual product page.
By using the services offered on the project-o2.org website, the user accepts these terms. An integral part of these terms are the data protection provisions which you can find and read on the Data Protection page. The terms are available for reading at any time on these pages, and we reserve the right to modify them without prior notice.

Hereinafter, 'Magic forest d.o.o.' refers to the service provider, and 'project-o2.org' refers to the website and online store.
For all orders and purchases in the project-o2.org Webshop, exclusively the sales terms stated here apply.
BASIC TERMINOLOGY

User: a person who uses the project-o2.org website for the purpose of purchasing items advertised on it or obtaining information about a specific item.
Buyer: any person who, after viewing and selecting a product, places an order for an item.
Consumer: any natural person who is a buyer, purchasing products or using the project-o2.org website outside of their commercial, business, artisanal, or professional activities.
CONCLUSION OF THE CONTRACT
Displaying products in the online store does not constitute a legally binding offer but merely a non-binding online catalogue. When purchasing an item, you submit a binding order for the items in your shopping cart. The order confirmation is issued immediately upon sending the order and does not constitute acceptance of the contract. We may accept your order by sending an order acceptance via email or by dispatching the goods within two working days (excluding Saturday and Sunday).
All products marked as 'Available' or 'In Stock' can be added to the shopping cart by clicking on the cart icon or by clicking 'Add to Cart'. Once you decide to make a purchase, by clicking the 'Cart' button you begin the ordering process through one of the two available options:
- You can complete your purchase as a registered buyer by creating an account, which will simplify your future orders. To open an account, you must provide, among other things, your name, email address, and a password. The password must be kept confidential and must not be disclosed to third parties.
- You can also complete your purchase as a guest buyer.
Benefits related to purchase and delivery can only be obtained if you complete your purchase as a registered buyer.
To complete your order, click the 'Buy' button. In doing so, you submit a binding offer to purchase the items in your shopping cart. Prior to that, you can review and modify the items in your cart. From that moment on, it is not possible to change the order or the details. If you wish to change your order or details, please contact our customer service as soon as possible.
The sales contract is concluded at the moment the invoice is issued.
In accordance with the Consumer Protection Act, in relations between consumers (end users) and Magic forest d.o.o., in the event of a material defect in a product, the provisions of the Law on Obligations (NN 35/05, 41/08, 125/11, 78/15) regarding liability for material defects shall apply.
The seller is liable for material defects in the item that existed at the time of risk transfer to the buyer, regardless of whether they were known to him.
The seller is also liable for those material defects that appear after the risk has passed to the buyer if they are the result of a cause that existed beforehand.
It is assumed that a defect appearing within six months of the risk transfer existed at the time of the risk transfer, unless the seller proves otherwise or if the nature of the item or defect implies otherwise.
When material defects exist:
- if the item does not have the necessary characteristics for its normal use or for commerce at the time of risk transfer (e.g. delivery)
- if the item does not have the necessary characteristics for the special use for which the buyer is purchasing it, and which was or should have been known to the seller
- if the item does not have the properties and features that are expressly or implicitly agreed upon or prescribed
- when the seller delivers an item that does not conform to the sample or model, except if the sample or model was shown solely for informational purposes
- if the item is improperly assembled, provided that the assembly service is included in the fulfillment of the sales contract
The manufacturer, in terms of liability for material defects and the warranty for the conformity of the sold item, is the manufacturer, the importer, and any other person who represents themselves as the manufacturer by affixing their name, brand, seal, or other mark on the item.
All customer rights regarding the warranty are defined on a separate 'Warranty' page which you can find on project-o2.org.
According to the European Union Regulation of 15 February 2016, disputes related to purchases made via the webshop throughout the EU can be resolved through the ODR platform, which you can access here ( https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage).
If you encounter a problem during an online purchase within the EU (e.g., defective product, inability to exchange the product, etc.), you can submit your complaint in a faster and simpler way via the above link.
The platform can be used by both consumers and merchants, and the complaint can be submitted in any of the 23 official EU languages.
In accordance with Article 10(4) of the Consumer Protection Act ('Narodne novine', no. 19/22), you have the right to submit a complaint expressing your dissatisfaction with the provided service.

The contractual relationship resulting from a purchase through project-o2.org is governed by Croatian law, and for all disputes arising from the contractual relationship, Croatian courts have jurisdiction, excluding the United Nations Convention on Contracts for the International Sale of Goods and the rules on the determination of the applicable law. The language of the contract is Croatian.
